10. Biometric Information
Where the Services use biometric identifiers (for example, for identity verification in connection with dashboard access or remote video), the following applies. This section reflects the requirements of the Illinois Biometric Information Privacy Act (BIPA) and comparable laws.
- Consent. We collect, capture, or store a biometric identifier only after informing you in writing of the purpose and the length of time for which it will be collected, stored, and used, and after obtaining your written consent. An electronic signature satisfies this requirement.
- Purpose. We use biometric identifiers solely to verify identity and secure access to the Services, and for no incompatible purpose.
- No sale. We do not sell, lease, trade, or otherwise profit from your biometric identifiers or biometric information.
- Limited disclosure. We disclose biometric data only with your consent, when required to complete a transaction you request, or when required by law or valid legal process.
- Retention and destruction. We retain biometric identifiers only as long as needed for the purpose collected, and we permanently destroy them when that purpose has been satisfied or within three (3) years of your last interaction with us, whichever occurs first, in accordance with our written retention schedule.
- Safeguards. We store, transmit, and protect biometric data using a reasonable standard of care and in a manner at least as protective as we use for other confidential and sensitive information.
11. Your Privacy Rights
Depending on your state of residence, you may have some or all of the following rights regarding your personal information:
- Access / Know – confirm whether we process your personal information and obtain a copy.
- Correct – request correction of inaccurate personal information.
- Delete – request deletion of your personal information.
- Portability – obtain a portable copy of certain information.
- Opt out – opt out of targeted advertising, the "sale" or "sharing" of personal information, and certain profiling (see Section 9).
- Withdraw consent – where processing is based on consent.
- Non-discrimination – you will not receive discriminatory treatment for exercising these rights.
- Appeal – if we deny your request, you may appeal by replying to our decision; if your appeal is denied, you may contact your state Attorney General.
How to exercise your rights. Submit a request to info@heysuperior.com. We will verify your identity before responding and will respond within the timeframe required by applicable law (generally 45 days, extendable where permitted). You may use an authorized agent where the law allows; we may require proof of authorization.
State laws use different terms and thresholds, and not every right is available in every state. We honor the rights available to you under the law of your state of residence, including the comprehensive privacy laws now in effect in Minnesota, Iowa, Indiana, Nebraska, and other operating states, and BIPA in Illinois.
12. Data Retention
We retain personal information and Property Data for as long as needed to provide the Services and, thereafter, for the applicable warranty and limitations period, and as needed to comply with legal, tax, accounting, and dispute-resolution obligations. Project files such as 3D CAD models, renderings, telemetry reports, and signed documents are retained for this period. Biometric identifiers are retained only as described in Section 10. When information is no longer needed, we delete or de-identify it.
13. Data Security and Account Security
We use reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, alteration, and disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Your homeowner progress dashboard is protected by credentials that are personal to you. You are responsible for keeping your login credentials confidential, using a strong and unique password, and notifying us promptly at info@heysuperior.com if you suspect unauthorized access. Do not share your credentials.
14. Children's Privacy
The Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13 (or a higher age where required by state law). If you believe a child has provided us personal information, contact us and we will delete it.
15. SMS / Mobile Messaging
If you opt in to SMS, message frequency varies by project term and length. Message and data rates may apply. You can opt out at any time by replying STOP, and get help by replying HELP or contacting info@heysuperior.com. Mobile opt-in data and consent are not shared with third parties for their own marketing purposes. See the SMS terms in our Terms of Service.
16. Third-Party Links
The Services may link to third-party websites and services that we do not control. This Policy does not apply to those sites, and we are not responsible for their privacy practices. Review their policies before providing information.
17. Changes to This Policy
We may update this Policy from time to time. We will post the updated version with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Services after an update takes effect constitutes acceptance of the revised Policy.
